PUBLIC HEARING OF
PLEASE TAKE NOTICE that should the Executive Order suspending New York Open Meetings Law not be extended past February 26, 2021, the Village of Bellport Zoning Board of Appeals will hold a public hearing on Wednesday, March 24, 2021 at 7 pm in the Bellport Community Center, 4 Bell Street, Bellport, NY to consider the following application. If the suspension of the New York State Open Meetings Law is extended past the above referenced date, the meeting will be streamed live over the internet and interested parties can find the link at www.bellportvillageny.gov.
Taylor Phillips, 44 New Jersey Avenue, Bellport, NY is seeking the following variances to install pool equipment in the side yard and a shed in the rear yard:
Sec. 21-272. – Accessory buildings and structures.
(a)In the Residence B District all accessory building shall be located in the rear yard of a lot. No accessory building shall
exceed fifteen (15) feet in height and must be set back at least ten (10) feet from any property line.
Proposed: Shed located 5 feet from side and rear yard property line.
Sec. 21-410. – Driveways and curb cuts.
(d) All driveways and or curb cuts shall not be located any closer than ten (10) feet to any side yard lot line in the Residence A and AA zones and seven and one-half (7½) feet to any side yard lot line in all other zoning districts.
Proposed: Driveway located 2 feet from side yard lot line.
Sec. 21-1.- Definitions
Swimming pool, family. Any body of water in an artificial or semi-artificial receptacle or other container, whether located indoors or outdoors, used or designed, arranged or intended to be used for swimming and/or wading by adults and/or children, including but not limited to all buildings, structures, appurtenances, equipment, appliances and other facilities appurtenant thereto designed for operational and/or maintenance purposes.
Sec. 21-501. – Location.
- Lot location: All pools shall be located in the rear yard of interior lots or the designated rear yard of corner lots.
Proposed: Pool equipment located in the side yard.
The property is located in the “B” Residence District. All persons with an interest may attend and will be heard. The Community Center is handicapped accessible. The Suffolk County Tax Map number is 0202-5-2-16.2.
