NOTICE OF
PUBLIC HEARING
PLEASE TAKE NOTICE thatthe Village of Bellport Zoning Board of Appeals will hold a public hearing on Thursday, July 20, 2023 at 7 pm in the Bellport Community Center, 4 Bell Street, Bellport, NY to consider the following application:
Caroline Harless, 9 Second Street, Bellport is amending the existing application by removing the request to raise the existing garage, convert it to storage and construct a carport attached to the garage/storage building and is now requesting to demolish the existing garage and construct a new 754 square foot garage. The request to construct a pool in the side yard remains. The work will require the following variances;
Sec. 21-272. Accessory buildings and structures.
- In the Residence B District all accessory building shall be located in the rear yard of a lot. No accessory building shall exceed fifteen (15) feet in height and must be set back at least ten (10) feet from any property line. On corner lots or through lots the accessory building must be set back at least thirty-five (35) feet from the lot line abutting a street.
Proposed: Garage located in a side yard 7.2 feet from the rear yard property line
Sec. 21-1. Definitions.
Swimming pool, family. Any body of water in an artificial or semi-artificial receptacle or other container, whether located indoors or outdoors, used or designed, arranged or intended to be used for swimming and/or wading by adults and/or children, including, but not limited to, all buildings, structures, appurtenances, equipment, appliances and other facilities appurtenant thereto designed for operational and/or maintenance purposes.
Sec. 21-501. Location.
(a) Lot location: All pools shall be located in the rear yard of interior lots or the designated rear yard of corner lots.
(b) Setbacks: All outdoor swimming pools, including above ground pools shall be subject to:
(1) Minimum side and rear yard setbacks of fifteen (15) feet as measured from the edge of the water;
Proposed: Pool and pool equipment located in side yard: pool equipment located 10 feet from the side yard lot line and 9.6 feet from the rear yard property line
The single-family dwelling is located in the “B” Residence District. The Suffolk County Tax Map Number is 0202-5-2-39.1.
All persons with an interest may attend and will be heard. The Community Center is handicapped accessible.
