ZBA Hearing for 15 New Jersey Avenue – August 15, 2019 at 7:00 pm in the Community Center

NOTICE OF  

PUBLIC HEARING

 

PLEASE TAKE NOTICE that the Village of Bellport Zoning Board of Appeals will hold a public hearing on Thursday, August 15, 2019 at 7 pm in the Bellport Community Center, 4 Bell Street, Bellport, NY to consider the following application:

Edward Baker, 15 New Jersey Avenue, Bellport, NY seeks the following variances to construct a 12 foot x 25 foot 9 inch rear addition and add a bilco cellar entrance on the south side of a single family dwelling:

Sec. 21-264. – Height.

The height requirements in a Residence B District shall be the same as in the Residence A District, as set forth in section 21-218 of this chapter.  

Sec. 21-218. – Height (Pyramid Law).

In the Residence A District no building hereinafter constructed, erected or altered shall exceed thirty-two (32) feet in height, and must be set back from all property lines so that the height of any point of the building is not greater than the horizontal distance of the point from the nearest property line to the building or structure at that location or protrude through a diagonal line formed by a forty-five-degree pyramid angle from all property lines. Chimneys are exempt from said restrictions.

Proposed: Addition protrudes through the pyramid by 1 square foot/6 cubic feet on north side.

Sec. 21-267. – Side yards.

In the Residence B District, there shall be two (2) side yards, one on each side of the building, the total width of both to be not less than forty (40) feet and no one side yard being less than fifteen (15) feet in width.

Proposed: Addition to be set back 10 feet 4 inches from north side property line, total side yards to equal 33 feet 11 inches; new bilco door added to north side of existing dwelling with total side yard width to equal 27.6 feet.

The Suffolk County Tax Map number is 0202-5-6-4. The property is in the “B” residence district. All persons with an interest may attend and will be heard. The property The Community Center is handicapped accessible.
