ZBA Hearing – 6 Gerard Street – May 26 at 7:00 pm



PLEASE TAKE NOTICE that should the Executive Order suspending New York Open Meetings Law not be extended past May 25, 2021, the Village of Bellport Zoning Board of Appeals will hold a public hearing on Thursday, May 26, 2021 at 7 pm in the Bellport Community Center, 4 Bell Street, Bellport, NY to consider the following application. If the suspension of the New York State Open Meetings Law is extended past the above referenced date, the meeting will be streamed live over the internet and interested parties can find the link at www.bellportvillageny.gov.

Vincent Dente, 6 Gerard Street, Bellport, NY is seeking the following variances to construct an in-ground pool on his property:

Sec. 21-223. – Corner lots.

In the Residence A District, no building or structure shall be erected on a corner lot having a total area of less than forty thousand (40,000) square feet or having frontage of less than one hundred seventy-five (175) feet upon a street. That portion of a corner lot which has frontage upon the street which the main entrance of the building faces, as shown by plans or physical layout, shall be deemed the front thereof; that portion of the corner lot having frontage upon another street shall be deemed a side yard.

Sec. 21-225. – Building area.

  • Main building and accessory buildings: In the Residence A District the maximum total building area for the main building and all accessory buildings shall not exceed fifteen (15) percent of the total lot area.

Proposed:  Building area of 15.52%

  • Accessory structures: In the Residence A District the total maximum area for occupancy of accessory structures shall not exceed twenty-five (25) percent of the total rear yard area. If an accessory structure is located in the front and/or side yards then it must be included with and conform to the total lot area coverage set forth in subsection (a).

Proposed: Rear yard building area of 27.55%

Sec. 21-226. – Accessory buildings and structures.

 (b)  In the Residence A District, unless addressed specifically elsewhere in this chapter, all structures and accessory structures must be located in the rear yard of a lot.

Sec. 21-501. – Location.

(a)  Lot location: All pools shall be located in the rear yard of interior lots or the designated rear yard of corner lots.

Proposed: In-ground pool partially located in side yard.

The Suffolk County Tax Map number is 0202-11-4-12.3. The property is in the “A” residence district. All persons with an interest may attend and will be heard. The Community Center is handicapped accessible.
