NOTICE OF
PUBLIC HEARING
PLEASE TAKE NOTICE that the Village of Bellport Zoning Board of Appeals will hold a public hearing on Thursday, December 15, 2022 at 7 pm in the Bellport Community Center, 4 Bell Street, Bellport, NY to consider the following application:
William Potabi, 9 Country Road, Bellport is seeking the following variances for first and second story additions, a covered front porch, a covered rear patio, a detached garage and second curb cut at the rear of a through lot:
Sec. 21-218. Height (Pyramid Law).
In the Residence A District no building hereinafter constructed, erected or altered shall exceed thirty-two (32) feet in height, and must be set back from all property lines so that the height of any point of the building is not greater than the horizontal distance of the point from the nearest property line to the building or structure at that location or protrude through a diagonal line formed by a forty-five-degree pyramid angle from all property lines. Chimneys are exempt from said restrictions. Accessory buildings and structures shall not be subject to the pyramid law.
Sec. 21-264. Height.
The height requirements in a Residence B District shall be the same as in the Residence A District, as set forth in section 21-218 of this chapter.
Proposed: Pyramid encroachment 3,989.94 Cubic Feet, 674.58 square feet
Sec. 21-266. Front yard.
In the Residence B District, there shall be a front yard having a depth of not less than forty (40) feet except that if forty (40) percent or more of the frontage on that side of the street between two (2) intersecting streets is improved with buildings, a majority of which have an average front yard line greater than forty (40) feet, the variation between such setbacks establishing the average being not more than six (6) feet, then no building shall project beyond the average front yard so established. However, this regulation shall in no case require front yard depth of more than sixty (60) feet.
Proposed: 27 feet setback
Sec. 21-267. Side yards.
In the Residence B District, there shall be two (2) side yards, one on each side of the building, the total width of both to be not less than forty (40) feet and no one side yard being less than fifteen (15) feet in width.
Proposed: North side yard setback 12 feet 11 inches; south side yard 11 feet 8 ½ inches; total side yards 24 feet 7 ½ inches
Sec. 21-270. Interior through lots.
(a) The designation of front and rear yard for interior through lots shall accord with the orientation of existing principal dwelling. The designation of front and rear yards for new construction on vacant lots shall be made by the building inspector.
(b) Interior through lots in Residence B District shall be subject to the following minimum rear yard set backs:
(2) Thirty-five (35) feet for any accessory buildings;
Proposed: Accessory building (garage) set back 20 feet from property line
Sec. 21-271. Building area.
- In the Residence B District the maximum total building area for the main building and all accessory buildings shall not exceed twenty (20) percent of the total lot area.
Proposed: Total lot area coverage of 24.84%
Sec. 21-272. Accessory buildings and structures.
Proposed: Accessory building (garage) set back 20 feet from property line; height of 20 feet
Sec. 21-410. Driveways and curb cuts.
(a) No new driveway or curb cut shall be constructed and no existing driveway or curb cut may be expanded which connects private property to a village street unless said driveway or curb cut is in compliance with this section and a building permit has been issued by the village building inspector. Nothing herein shall be construed to require a building permit for resurfacing or repairing existing driveways.
(b) No privately owned property shall have more than one curb cut or driveway connecting the privately owned property to a village street.
Proposed: Second curb cut at rear of property
The single-family dwelling is located in the “B” Residence District. The Suffolk County Tax Map Number is 0202-7-3-20.
All persons with an interest may attend and will be heard. The Community Center is handicapped accessible.
