NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Village of Bellport Clerk’s Department.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about August 4, 2025 the Village of Bellportwill submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Project Funding funds under the Consolidated Appropriations Act, 2024 (P.L. 118-42) and the Further Consolidated Appropriations Act, 2024 (P.L. 118-47), to undertake a project known as the Bellport Village Marina Project for the purpose of improving the municipal marina that provides essential dock space for emergency services, workboats, and recreational vessels. The primary focus of the project is to ensure the safe harboring of vessels at the municipal marina. Currently, the marina is vulnerable to wind-driven waves from the east and southeast, which have historically caused damage to vessels and deterioration of marina infrastructure. To address these issues, the marina improvements will include the installation of a vertical wave screen, designed to limit wave penetration during storm events, thereby protecting the interior of the marina and ensuring a safe basin for navigation and mooring under typical conditions. Additional enhancements will include the reconstruction of ferry and emergency responder docks, spot dredging within the marina, repairs and replacement of bulkhead sections, and refurbishments to the boat launch area. The municipal marina is located at the southern terminus of Bellport Lane, Village of Bellport, Suffolk County, New York 11713. The estimated total project cost is $4,038,563 and the Community Project Funding grant awarded is $2,800,000.

FINDING OF NO SIGNIFICANT IMPACT

The Village of Bellport Clerk’s Department Development has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Village of Bellport Clerk’s Department located at 29 Bellport Lane, Bellport, New York 1713, and may be examined or copied weekdays 8:00 A.M to 4:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Village of Bellport Clerk’s Department. All comments received by August 1, 2025 will be considered by the Village of Bellport Clerk’s Department prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Village of Bellport Clerk’s Department certifies to HUD that Katie Mehrkensin hercapacity as Deputy Clerk consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Village of Bellport Clerk’s Department to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and the Village of Bellport Clerk’s Department certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Village of Bellport Clerk’s Department; (b) the Village of Bellport Clerk’s Department has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at CPDRROFNYC@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
