Final Notice and Public Explanation of a Proposed Activity in a Federal Flood Risk Management Standard Designated Floodplain and Wetland

This is to give notice that the Village of Bellport under 24 CFR Part 58 has conducted an evaluation as required by Executive Order(s) 11988, as amended by Executive Order 13690 and Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under Community Project Funding. The proposed project is located at the southern terminus of Bellport Lane in the Village of Bellport, Suffolk County and is located in the Federal Flood Risk Management Standard (FFRMS) floodplain and surrounded by estuarine and subtidal waters. The extent of the FFRMS floodplain was determined using a Climate Informed Science Approach (CISA) and wetlands were determined using the USFWS National Wetlands Inventory (NWI) Mapper.

The Proposed Project involves a series of improvements to the Bellport Municipal Marina. The primary focus of the Project is to ensure the safe harboring of vessels at the Municipal Marina. Currently, the marina is vulnerable to wind-driven waves from the east and southeast, which have historically caused damage to vessels and deterioration of marina infrastructure. To address these issues, the marina improvements will include the installation of a vertical wave screen, designed to limit wave penetration during storm events, thereby protecting the interior of the marina and ensuring a safe basin for navigation and mooring under typical conditions. Additional enhancements will include the reconstruction of ferry and emergency responder docks, spot dredging within the marina, repairs and replacement of bulkhead sections, and refurbishments to the boat launch area. All proposed developments within the Municipal Marina will be designed in accordance with current codes and standards, addressing the increasing public demand for access to recreational boating. The entire Project Area is located within the 100-year and 500-year Floodplain.

The Village has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain/wetland: “no-action” alternative, which if pursued, the need for the necessary marina infrastructure improvements which are essential to ensure safety, functionality, and resilience against wind-driven wave energy would not be addressed. Environmental considerations are integrated into the Project to bolster resilience against extreme weather events, safeguarding the marina’s longevity; thus, the Project is in compliance with Executive Order 11988 and 11990.

The Village of Bellport has reevaluated alternatives to building in the floodplain/wetland and has determined that it has no practicable alternative to the Project and no significant environmental impact on floodplain/wetland development. Environmental files documenting compliance with Executive Order 11988, as amended by Executive Order 13690 and Executive Order 11990, are available for public inspection, review, and copy upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplain/wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain/wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain/wetland, it must inform those who may be put at greater or continued risk.
